TERMS AND CONDITIONS (August 2015)

YOU ARE REQUESTED TO READ THE TERMS AND CONDITIONS OF CAR PARKING CAREFULLY AND TO FOLLOW THE PROCEDURES RECOMMENDED IN THOSE TERMS AND CONDITIONS WHICH ARE FOR YOUR BENEFIT.

SHOULD YOU WISH TO MAKE A COMPLAINT YOU ARE REQUESTED TO FOLLOW THE COMPLAINTS PROCEDURE SET OUT BELOW WHICH WILL ENSURE THAT YOUR COMPLAINT IS BROUGHT PROMPTLY TO THE ATTENTION OF THE MANAGEMENT.

YOUR BOOKING IS ACCEPTED ON THE UNDERSTANDING THAT YOU HAVE READ AND ACCEPTED THESE TERMS AND CONDITIONS.

 

1. COMPANYS LIABILITY

 

Every effort is made by means of trained staff, well maintained Vehicles, equipment and security cameras to make the Car Parks secure and to collect and deliver customers' cars safely to and from the meeting points. However, parts of the Car Park are open to the public and whilst staff have instructions to remove anyone not authorised to be on the premises, the Company cannot guarantee the security of your Vehicle, its contents, your belongings nor your personal safety.

 

1.1

The Company does not accept liability for damage to vehicles or other property arising from acts of nature affecting the Car Park's open-air surface operations. Nor will the Company accept responsibility for chips to paintwork. The Company will also not accept responsibility for damaged windscreens or other glass, other than where the same is proved and to the extent that it is proved to be caused by their negligence.

The company's car parks, unless otherwise stated, are open air compounds. We will not be held responsible for acts of nature including but not limited to dust, pollen, rain and bird droppings.

 

1.2

The company does not accept responsibility for any mechanical or electrical failure of vehicles whilst in its custody. Nor will the company accept responsibility for damaged or punctured tyres, only where the same is proved and to the extent that it is proved by their negligence, wilful default or breach of statutory duty. The Company will not be held responsible for any deterioration in the condition of the vehicle whilst in our storage facilities.

 

1.3

The Company will accept liability in respect of the death or personal injury or loss or damage to personal belongings sustained by the customers and others in the Car Park only where the same is proved and to the extent that it is proved to be caused by their negligence, wilful default or breach of statutory duty.

 

1.4

The Company will not accept liability for damage to your vehicle whether caused accidentally or by way of vandalism, theft of, or from, your vehicle while the vehicle is in the car park, unless such damage or theft is caused by the negligence of the Company or its employees and then only to the extentthat the Company or its employees have caused or contributed to the relevant damage or theft.

 

 

1.5

Any Damage to, or theft from your vehicle that occurred during your stay must be reported to a member of staff immediately and in any event before exiting the car park in line with the complaints procedure set out below. Failure to do this will result in the immediate refusal of your claim.

 

1.6

The Company requires that you will retain the return instructions/numbered receipt for your car in a safe place ready to present on your return. The Company cannot be held responsible if you lose your return instructions/numbered receipt and this is presented to the Company by a third party who uses it to fraudulently take delivery of your car.

 

1.7

The Company is responsible for ensuring that your car is driven carefully, and that employees and subcontractors of the Company are insured for any loss or damage to your vehicle which occurs as a result of the negligent driving of the said employees and subcontractors as part of the service. As such, the Company will pay to you the cost of repairing any damage to your vehicle which is proven to be caused by the negligence of the Companies employees or subcontractors.

 

1.8

The Company does not accept liability for any failure by it to perform its obligations due to an event beyond its reasonable control. A non-exhaustive list of such events include war or threat of war, acts or threats of terrorism, riots, civil strife, industrial disputes, natural and nuclear disasters, fire, government regulations, closure or congestion of airports, cancellation or changes by airlines and adverse weather conditions.

 

1.9

The Company does not accept liability for any indirect or consequential loss or any loss of profit or enjoyment, loss of revenue, data or loss of earnings.

 

1.10

The company will not be held responsible for any loss or damage howsoever caused that is covered by any additional insurance policy that you may have such as travel, car or other specific insurance. The Company will not be held responsible for any events that you have not arranged insurance for or have insurance excesses for.

 

2. COMPLAINTS PROCEDURE

 

2.1

Claims cannot be considered once Vehicles have left the premises, so please check your car before leaving.

 

2.2

Should your vehicle suffer damage whilst in the Company's care or should you lose the Vehicle or any of your possessions from the Vehicle whilst it is in the Car Park you must immediately inform the Duty Manager of the occurrence and where appropriate a Report Form will be completed and dealt with by our Customer Services Manager.

2.3

Failure to report a claim and submit a claim form prior to leaving the premises will result in the immediate dismissal of your claim.

2.4

In cases of theft you must immediately inform the Police and notify your insurers promptly.

 

2.4

In the unlikely event that damage is caused to your Vehicle through negligence on the part of the Company, then the Company reserves the right to undertake repairs to your Vehicle on your behalf in a manner which restores it to the condition in which it arrived at the Car Park and in that event no claim by you can be made.

Before submitting a claim, you are requested to check Condition No.1 and to satisfy yourself that the subject matter of your claim falls within one of the defined areas of responsibility. Failure to comply with the above procedure may prejudice your position and it should be noted that our Report Form makes no representations as to the Company's liability.

 

2.5

This complaints procedure does not affect your consumer or statutory rights to take legal action should you see fit.

 

2.6

We will photograph or video your vehicle when you enter the Car Park before being moved to Storage, and after any damage is reported.  We will report any fraudulent claims to the Police.

 

3. SECURITY

3.1

When you have parked your vehicle, unless requested by the Company or one of its employees or agents not to do so, please ensure before leaving the Car Park that all the windows of your Vehicle are securely closed, apply your handbrake properly, and in the case of convertible cars, your hood is up and secure, with all lights and electrical equipment switched off.

 

3.2

As far as contents are concerned; wherever possible take your possessions with you when you leave your Vehicle. If you have to leave possessions in your Vehicle do not leave them on the seats where they are visible. Put them in the boot and lock it. Even then, it is a condition of acceptance of any Vehicle that you remove all loose and valuable items as we cannot accept responsibility for their loss resulting from your failure to do so.

 

3.3

You are reminded that your motor insurance policy may not cover possessions in your Vehicle for their loss.

 

3.4

While the Company uses reasonable endeavours to ensure that our car parks are secure, the Company does not guarantee that they are a completely secure environment.

 

3.5

You must drive carefully and responsibly in the car park. Please also ensure that any children and animals are supervised at all times in the car park and are accompanied by a responsible adult when using the car park. Please be aware of all vehicles moving in the car park.

 

3.6

Take your luggage to the bus on which you travel to or from the airport. It is your responsibility to ensure that the driver loads and unloads your entire luggage. The company cannot therefore be liable for lost luggage nor for another customer identifying your luggage as their own.

 

4. ARRIVAL TIMES

 

4.1

You are advised to allow for sufficient journey time to arrive at the Car Park at least 45 minutes prior to the check-in time given to you by your airline, travel operator or travel agent. In standard road conditions it can take up to 10 minutes to get to the airport but we cannot be held liable for any loss you might suffer should bad traffic cause you to miss your flight.

 

4.2

Whilst directions to the Car Park are usually provided, the Company cannot in any circumstances be held liable for any loss you might suffer should you get lost and as a result miss your flight.

 

4.3

The Company does not accept responsibility if you miss your flight or airline check in has closed because you have not left enough time to get in to the car park, and then from the car park to the terminal.

 

5. BOOKINGS, PRICES, AMENDMENTS AND CANCELLATIONS

 

5.1

Car parks are priced per 24 hour period or part thereof. Prices are subject to change. Quotes are valid at the time of booking only. The number of “days” (24 hour periods) charged for when you pre-book is calculated on the basis of the times you select when making your booking. Prices may be varied from time to time; the Company reserves the right to change prices whether or not it gives notice of its intention to do so.

 

5.2

Non-arrivals and cancellations within 24 hours of the planned arrival date will be charged in full, unless otherwise agreed in writing.

 

5.3

If your actual entry and exit time changes from that specified in your booking and as a result your actual time in the car park runs into another 24 hour period over and above that booked, the parking outside of the booked parking period will be charged at a rate of £8.00 per day or part thereof, and this amount must be settled before you leave the car park.

 

5.4

Your booking is non-transferrable, your booking is only valid for the car, times, dates and prices specified in your booking.

 

5.5

You should give us at least 24 hours’ notice of your intention to return early. Failure to do so will result in a

£10 administration fee.

 

5.6

Bookings can be cancelled for any reason within 7 days of the bookings being made. Any money paid will be refunded to you less an administration fee of £10.

 

5.7

Any outstanding balance will need to be paid on your return for any car parking charges due if you decide to park longer than agreed or if you have incurred any extra charges.

 

5.8

All prices quoted are inclusive of VAT, are in pounds sterling and will be fixed and confirmed at the time of booking.

 

5.9

You must notify us about any changes or alterations regarding flight times or return dates by email, where you should state the proposed changes and include your booking reference number.

 

5.10

All bookings are subject to availability, the Company reserves the right not to accept or fulfil a booking.

 

5.11

Email Disclaimer

The content of any email and any attachment(s) may contain legally privileged information and is therefore confidential and intended for the addressee only. If you are not the original intended recipient, you must not copy, distribute, disclose or use any of the information in it. If you have received an email in error from us, please notify us immediately by emailing the sender and then delete the email and any copies from your system. If you are not the intended recipient, any disclosure, copying, distribution or any action taken or omitted to be taken in reliance on it, is prohibited and may be unlawful. Liability cannot be accepted for statements made, which are clearly the senders own and not made on behalf of the Company.

5.12

Credit Card Details

We do not store credit card details or any personal information but may contact you by email to keep in contact with you regarding special offers etc.

 

6. RELOCATION OF VEHICLES

 

6.1

You must ensure that, before leaving the Vehicle with the Company that it is in a roadworthy condition, (including tyres which meet the standards required by law), taxed and holds a current MOT if applicable. The Company reserves the right to refuse to accept a car into their care which fails to meet these conditions as this could lead to it becoming liable under the Road Traffic Acts. The Company cannot accept ownership of any vehicle that does not comply with Road Traffic Regulations. You will be responsible for any fines, liabilities we incur as a result of failing to comply.

 

6.2

You should point out to the Company any special driving attachments or car features such as disabled driver Controls, key codes, immobilisers, special starting instructions etc. as we will not be liable for damage resulting from a driver’s lack of familiarity with them.

 

6.3

The Company reserves the right to move your Vehicle within or outside the Car Park by driving or otherwise to such extent as the Company, its employees or agents may in their discretion think necessary for the efficient arrangement of its parking facilities at the Car Park, or in emergencies or to avoid accidents or obstructions.

Ignition keys to your Vehicle must therefore be left with the office staff at the time of parking it. To the extent that it may be necessary to do so in the exercise of the rights conferred upon the Company under this condition the Company, its employees or agents shall have the right to drive or otherwise take the Vehicle on the public highway. The drivers are fully insured by the Company for this purpose.

6.4

It is your responsibility to leave a set of keys with us, your vehicle will be moved to one of our secure car parking locations where it will be stored for the duration of your stay.

6.5

The Company takes no liability for any faulty car keys, alarm fobs or house keys left on the key-ring.  We require customers to remove all unnecessary keys from the car key, as the company will not assume responsibility for any other keys left in their possession. Where possible, we require you to have a spare key for your vehicle which we require you take with you.

 

6.6

Our staff are fully insured and licenced to drive all types of vehicles to and from our storage facilities but will remain under the customers insurance while being stored with us. We have various car parks around the Stansted area with the furthest one being only 6 miles from our drop off location. We ask all customers to allow 20 miles for the car to travel while in our care in case of road closures or events outside our control. In some cases there may be more than one member of staff in the vehicle while being moved to and from the storage location.

 

6.7

The Company parks all vehicles, unless otherwise stated, in open air compounds. Therefore we are not responsible for acts of nature including but not limited to bird droppings, dust, pollen and rain on your vehicle. Should you wish to maintain your vehicle’s cleanliness, please supply your Driver with a cover for your vehicle.

 

6.8

You must not leave any dangerous, toxic or illegal substances in the vehicle.

7. SERVICE SPECIFIC INFORMATION

 

PARK AND RIDE

7.1

Please allow 5 minutes transfer time in usual circumstances from our office to the set down area.

MEET AND GREET

7.2

For meet and greet services you will be liable for all car parking costs in any of the Airport Car Parks, on arrival and collection of your vehicle. The usual fees for the set down area for 10 minutes waiting time is £2.50, after 10 minutes waiting time, there is a charge of £2.50 per minute, and a £20 charge if you return within half an hour, you will be required to pay the company's Porter your £2.50 on your arrival, so the company can exit the area and store your vehicle, if the company should receive any extra costs than the £2.50 10 min exit fee, you will be liable for all costs over the usual rate which will be payable on your return. Should you be delayed on your collection, making your way to the meeting point, and as a result the stay in the set down area/ car park exceeds 10 minutes you will be liable for all costs over the usual rate.

 

GENERAL

7.3

For any vehicle that takes up more than the single space allocated in your booking, e.g. long wheel base vehicles and larger vehicles, there may be an additional surcharge. Should you have a large vehicle please contact us before confirming your booking.

 

7.4

We do not store credit card information nor do we share any customer details with third parties.

 

7.5

Once you have phoned for collection, please make your way immediately to the Short Stay Car Parks Express Set Down area as directed. Any delay over 15 minutes from the time you called for collection will result in additional car park charges payable.

 

7.6

If at the end of the parking period your vehicle will not start, we may move your vehicle to a return bay, if you ask and accept the risk, oneof our employees will make one attempt to start your vehicle using a anti surge starter pack. If you still need help to start the vehicle, you will need to contact a breakdown Company, for which you will be liable for the costs incurred. If your vehicle does not start, you must arrange for it to be removed within 24 hours from the end of the parking period.  After this time we will charge you the daily parking charge rate of £7 per day.

 

ON YOUR RETURN

7.7

In order to reclaim your vehicle you must produce the receipt you received on your arrival. If you lose the receipt, we will need proof of your identity to confirm the details against the booking and the vehicles owner identity. We reserve the right to make other enquiries that we think are reasonable.  Failure to produce the receipt will delay your departure.

 

8. LIENS AND AGENCY INFORMATION

 

8.1

Every Vehicle in the Car Park is subject to a lien for all charges due or accruing from the Customer to the Company, and a general lien for all and any monies due from the Customers to the Company such liens to be in existence whenever the Vehicle is in the Car Park, notwithstanding that it may from time to time have been removed. If the said lien is not satisfied by the payment, within 28 days of notice given by the Company of its intention to sell the Vehicle in default of payment, the Company may sell the Vehicle by auction or otherwise and the proceeds of sale may be applied in and towards satisfaction of all sums owing to the Company by the customer together with the expenses of the sale, and in connection with such sale the Company shall be entitled to charge reasonable garage charges in respect of the period during which the Vehicle is in the possession of the Company.

 

8.2

Any balance of purchase price remaining after satisfaction of such sums shall be held by the Company on behalf of the registered owner of the Vehicle. Notice of intention aforesaid shall be deemed to have been properly and sufficiently given by the sending of written notice by prepaid post, addressed to the registered owner at his known address, whether or not the same is actually received.

 

8.3

Every person who enters into a contract with the Company for the parking of a Vehicle in the Car Park, does so on behalf of themselves and all other persons having any proprietary, possessory or other financial or material interest in the Vehicle.

 

9. DEFINITIONS

 

9.1

'Vehicle' shall mean the Vehicle which is received into the Car Park and shall include a car, caravan, caravanette, mobile home, transit van, truck, motor bicycle and other mechanical device on wheels or tracks, its equipment and accessories.

 

9.2

‘Company’ shall mean 'Car Storage Ltd'.

 

9.3

‘Car Park’ shall mean any car park operated by the Company.
